BeachCar™™ respects your privacy and is committed to protecting the personal information entrusted to us.
This Privacy Policy explains how BeachCar™, including its applicable parent, subsidiary, affiliated, or operating entities collectively referred to as “BeachCar™,” “we,” “our,” or “us,” collects, uses, discloses, retains, and protects personal information when you access or use the BeachCar™ website, mobile applications, vehicle rental services, host services, communications, and other products or services that reference this Privacy Policy.
BeachCar™ operates a vehicle access and rental platform. Depending upon the transaction, BeachCar™ may directly provide a vehicle for rental or may provide technology and related services that enable an independent vehicle owner or authorized vehicle provider, referred to in this Privacy Policy as a “Host,” to make a vehicle available to an eligible driver, referred to as a “Driver.”
This Privacy Policy applies to Drivers, Hosts, prospective Drivers and Hosts, website visitors, authorized additional drivers, account holders, and other individuals whose personal information is processed through the BeachCar™ Platform.
By creating an account, submitting information, requesting or accepting a vehicle rental, listing a vehicle, communicating through the Platform, or otherwise using BeachCar™, you acknowledge the data practices described in this Privacy Policy.
1. INFORMATION WE COLLECT
The information BeachCar™ collects depends upon how you interact with the Platform, whether you are a Driver or Host, the services you request, the vehicle involved, and the features you use.
A. Account and Identity Information
BeachCar™ may collect information including your:
Name;
Email address;
Telephone number;
Mailing or residential address;
Date of birth;
Account username;
Password or authentication credentials;
Profile photograph;
Driver license number;
Driver license issuing jurisdiction;
Driver license expiration date;
Government identification information;
Identity verification information; and
Other information reasonably necessary to establish or verify your identity.
We may use third party identity verification providers to verify some of this information.
B. Driver Eligibility Information
To determine whether an individual is eligible to rent or operate a vehicle through BeachCar™, we may collect or obtain information concerning:
Driver license status;
Driving history;
Motor vehicle records;
Vehicle related violations;
Restrictions associated with a driver license;
Insurance eligibility;
Rental eligibility;
Prior rental activity;
Reported accidents or vehicle incidents;
Fraud indicators;
Risk indicators; and
Other information reasonably necessary to evaluate eligibility to operate a vehicle through the Platform.
Where applicable law requires separate authorization before obtaining certain records, reports, or background information, BeachCar™ will obtain the required authorization separately from this Privacy Policy.
C. Host Information
If you list or provide a vehicle through BeachCar™, we may collect:
Your legal name and contact information;
Business information, if applicable;
Vehicle ownership or authorization documentation;
Vehicle registration information;
Vehicle identification number, commonly known as the VIN;
License plate information;
Vehicle make, model, year, trim, mileage, and specifications;
Vehicle photographs;
Vehicle condition information;
Maintenance information;
Safety information;
Inspection information;
Vehicle availability;
Rental pricing information;
Pickup and return information;
Insurance information;
Payment information;
Bank account or payout information;
Tax information; and
Information required to process payments to you or satisfy tax reporting obligations.
BeachCar™ may verify that a Host has the legal authority to list or provide a vehicle through the Platform.
D. Rental and Transaction Information
When a rental or reservation occurs, we may collect or create records concerning:
Vehicle selected;
Reservation dates;
Rental period;
Pickup location;
Return location;
Reservation modifications;
Rental extensions;
Cancellations;
Rental charges;
Deposits;
Refunds;
Fees;
Taxes;
Discounts;
Tolls;
Parking charges;
Fuel charges;
Electric vehicle charging;
Mileage;
Late returns;
Cleaning charges;
Damage assessments;
Claims;
Roadside assistance;
Vehicle recovery;

Other information associated with the transaction.
E. Payment and Financial Information
When payments are made through BeachCar™, payment information may be collected by BeachCar™ or by an authorized payment processor.
Depending upon the payment method and processor used, this information may include:
Payment card information;
Billing address;
Banking information;
Payment account identifiers;
Transaction information;
Refund information;
Deposit information;
Payout information; and
Fraud prevention information.
Where a third party payment processor directly processes payment credentials, BeachCar™ may receive a payment token, transaction identifier, payment status, card type, expiration information, or limited account information rather than the complete payment credential.
F. Insurance and Claims Information
BeachCar™ may collect information relating to insurance coverage, vehicle protection, accidents, damage, theft, personal injury, property damage, or other claims.
This may include:
Insurance company information;
Policy information;
Coverage information;
Claim numbers;
Accident reports;
Police reports;
Photographs;
Videos;
Repair estimates;
Repair invoices;
Damage documentation;
Statements from Drivers, Hosts, passengers, witnesses, or other individuals;
Correspondence with insurance companies;
Location information;
Vehicle information; and
Information reasonably necessary to investigate, administer, defend, or resolve a claim.
G. Vehicle and Trip Information
BeachCar™ may collect information about a vehicle and its use during a reservation where reasonably necessary to provide the rental service, protect vehicles and users, prevent fraud, investigate incidents, administer claims, or enforce BeachCar™ policies.
Depending upon the vehicle and technology being used, this information may include:
Vehicle location;
Pickup and return location;
Trip start and end information;
Mileage;
Odometer readings;
Fuel level;
Battery or charging level;
Vehicle status;
Vehicle diagnostic information;
Lock and unlock activity;
Trip duration;
Vehicle recovery information;
Toll activity;
Parking activity; and
Other operational information associated with a BeachCar™ rental.
Certain location information may constitute precise geolocation or sensitive personal information under applicable privacy laws.
BeachCar™ does not use precise trip location information for purposes unrelated to legitimate BeachCar™ operations except where the individual has provided appropriate authorization or where otherwise permitted by law.
H. Vehicle Telematics and Connected Vehicle Information
Some vehicles may contain manufacturer installed or separately installed telematics, GPS, connected vehicle, vehicle recovery, diagnostic, or fleet management technology.
Where BeachCar™ has lawful access to information generated by these systems, we may process information for purposes including:
Locating a rented vehicle;
Facilitating pickup or return;
Supporting remote vehicle access;
Responding to roadside assistance requests;
Recovering an overdue or unlawfully retained vehicle;
Investigating theft;
Confirming mileage;
Investigating damage or accidents;
Managing vehicle maintenance;
Protecting Drivers, Hosts, vehicles, and the Platform;
Preventing fraud; and
Enforcing rental agreements and Platform rules.
BeachCar™ will not use vehicle location technology as a means of conducting unrelated surveillance of a Driver.
Hosts are responsible for complying with BeachCar™ rules and applicable laws concerning any tracking, telematics, camera, audio, or other monitoring technology located within or attached to a Host vehicle.
I. Photographs, Videos, and Vehicle Condition Documentation
BeachCar™ may collect photographs or videos submitted before, during, or after a reservation, including:
Vehicle condition photographs;
Damage photographs;
Pickup photographs;
Return photographs;
Fuel or charging photographs;
Odometer photographs;
Driver identification photographs;
Vehicle registration photographs; and
Other documentation submitted in connection with a transaction.
Photographs may contain metadata or incidental personal information.
J. Communications
BeachCar™ may collect communications associated with the Platform, including:
Messages between Drivers and Hosts;
Communications with BeachCar™;
Customer support requests;
Emails;
Text messages;
Chat communications;
Telephone call records;
Complaint information;
Dispute information;
Survey responses; and
Other communications submitted to us.
Where telephone calls are recorded or monitored, BeachCar™ will provide notice when required by applicable law.
K. Website, Application, and Device Information
When you use the BeachCar™ website or applications, BeachCar™ and its technology providers may automatically collect information such as:
Internet Protocol address;
Browser type;
Device type;
Operating system;
Device identifiers;
Application identifiers;
Pages viewed;
Links or buttons selected;
Referring website;
Approximate location derived from an Internet Protocol address;
Date and time of access;
Session information;
Application performance;
System errors; and
Information concerning how you interact with the Platform.
L. Cookies and Similar Technologies
BeachCar™ may use cookies, software development kits, pixels, local storage, analytics tools, and related technologies to operate and secure the Platform, maintain sessions, remember preferences, understand Platform usage, diagnose technical problems, prevent fraud, and improve BeachCar™ services.
Where required by applicable law, BeachCar™ will obtain consent before activating nonessential tracking technologies.
Users may also be provided with privacy settings or cookie controls through the Platform.
M. Analytics and Session Replay
BeachCar™ may use analytics and session replay technologies to understand how users interact with the Platform, diagnose problems, improve functionality, detect errors, measure performance, and enhance the user experience.
These technologies may record information concerning page views, navigation, clicks, device characteristics, browser characteristics, and interactions with Platform features.
BeachCar™ will configure session recording technologies to restrict or mask sensitive information where reasonably practicable and will seek to exclude payment credentials, passwords, government identification numbers, and other information that is not necessary for analytics purposes.
N. Information From Other Sources
BeachCar™ may obtain information from third parties, including:
Identity verification providers;
Payment processors;
Insurance providers;
Claims administrators;
Vehicle data providers;
Motor vehicle record providers;
Fraud prevention providers;
Hosts;
Drivers;
Vehicle manufacturers;
Connected vehicle providers;
Roadside assistance providers;
Law enforcement agencies;
Public records;
Government agencies; and
Other service providers.
Information obtained from these sources may be combined with information already maintained by BeachCar™.
2. SENSITIVE PERSONAL INFORMATION
Depending upon how you use BeachCar™, we may process information considered sensitive under applicable privacy laws.
Sensitive information may include government identification information, driver license information, precise geolocation, financial account information, insurance information, and other information legally classified as sensitive personal information or sensitive data.
BeachCar™ processes sensitive information only where reasonably necessary to operate the Platform, provide requested services, verify identity and eligibility, protect users and vehicles, process transactions, manage claims, prevent fraud, satisfy legal requirements, or for another purpose permitted by applicable law.
Where applicable law requires consent before processing particular categories of sensitive information, BeachCar™ will request the required consent.
BeachCar™ does not use sensitive personal information to infer characteristics about individuals for unrelated advertising purposes.
3. HOW BEACHCAR™ USES PERSONAL INFORMATION
BeachCar™ may use personal information to:
Create and administer accounts;
Verify identity;
Determine Driver eligibility;
Verify Host identity and vehicle authorization;
Process vehicle reservations;
Facilitate direct BeachCar™ rentals;
Facilitate transactions between Drivers and Hosts;
Process payments and Host payouts;
Calculate fees, taxes, deposits, refunds, and other charges;
Provide customer support;
Communicate about reservations;
Facilitate vehicle pickup and return;
Provide roadside assistance;
Locate or recover vehicles when authorized and appropriate;
Administer insurance programs;
Investigate accidents and damage;
Administer claims;
Resolve disputes;
Detect and prevent fraud;
Protect against theft and unauthorized vehicle use;
Maintain Platform security;
Enforce BeachCar™ agreements and policies;
Comply with applicable laws;
Respond to lawful government requests;
Maintain tax and accounting records;
Improve BeachCar™ products and services;
Conduct analytics;
Diagnose technical problems;
Develop new Platform capabilities;
Conduct permitted marketing and promotional activities;
Measure the effectiveness of communications;
Protect the rights, property, and safety of BeachCar™, its users, and others; and
Establish, exercise, or defend legal claims.
BeachCar™ may also use information for another purpose disclosed at the time the information is collected or with the individual’s consent.
4. HOW BEACHCAR™ DISCLOSES PERSONAL INFORMATION
BeachCar™ does not disclose personal information indiscriminately.
Personal information may be disclosed in the circumstances described below.
Drivers and Hosts
Information may be disclosed between a Driver and Host when reasonably necessary to complete or administer a reservation.
For example, a Host may receive information necessary to identify an authorized Driver and coordinate pickup or return. A Driver may receive information necessary to identify the Host, locate the vehicle, and complete the rental.
BeachCar™ does not authorize Drivers or Hosts to use information obtained through the Platform for unrelated marketing, harassment, discrimination, surveillance, or other unauthorized purposes.
Service Providers
BeachCar™ may provide information to vendors and service providers that perform services on our behalf, including:
Cloud hosting;
Payment processing;
Identity verification;
Driver verification;
Fraud prevention;
Customer service;
Communications;
Analytics;
Vehicle technology;
Mapping;
Roadside assistance;
Claims administration;
Insurance related services;
Vehicle recovery;
Accounting;
Tax administration;
Information technology;
Cybersecurity; and
Professional advisory services.
These organizations may process personal information only as permitted by their agreements with BeachCar™ and applicable law.
Insurance and Claims Participants
BeachCar™ may disclose information to insurers, brokers, claims administrators, adjusters, repair facilities, attorneys, investigators, law enforcement agencies, vehicle owners, Drivers, Hosts, and other parties where reasonably necessary to investigate or administer an accident, insurance matter, vehicle damage matter, theft, or claim.
Legal and Safety Disclosures
BeachCar™ may disclose information when we reasonably believe disclosure is necessary to:
Comply with a subpoena, court order, warrant, or other lawful process;
Respond to a government request;
Protect the safety of an individual;
Prevent or investigate fraud;
Prevent theft or unauthorized vehicle use;
Locate or recover BeachCar™ or Host property;
Investigate a violation of BeachCar™ agreements;
Enforce our legal rights; or
Establish, exercise, or defend a legal claim.
Business Transactions
Information may be disclosed as part of an actual or proposed merger, acquisition, financing, investment, restructuring, reorganization, sale of assets, bankruptcy proceeding, or similar corporate transaction.
Any successor organization receiving personal information will remain subject to applicable privacy obligations.
5. SALE, SHARING, AND TARGETED ADVERTISING
BeachCar™ does not sell personal information in exchange for money unless a separate disclosure expressly states otherwise.
BeachCar™ does not sell precise vehicle location or Driver trip location information.
BeachCar™ does not permit third parties to use precise Driver trip location information for unrelated targeted advertising.
Certain privacy laws define “sale,” “sharing,” or “targeted advertising” more broadly than an exchange of information for money. Certain website advertising or analytics technologies can potentially fall within these definitions depending upon how the technology is configured and used.
Where BeachCar™ engages in an activity legally considered the sale or sharing of personal information or targeted advertising, BeachCar™ will provide the notices and privacy choices required by applicable law.
Where legally required, BeachCar™ will also recognize qualifying browser based privacy preference signals.
6. COOKIES AND PRIVACY CHOICES
Users may be able to control cookies and similar technologies through their browser settings, device settings, BeachCar™ privacy controls, or a cookie preference tool made available through the Platform.
Disabling certain technologies may affect Platform functionality.
Where applicable law requires BeachCar™ to recognize a qualifying universal privacy preference signal, BeachCar™ will process that signal as required by law.
7. COMMUNICATIONS AND MARKETING
BeachCar™ may send transactional communications concerning:
Account activity;
Reservations;
Vehicle pickup;
Vehicle return;
Payment activity;
Security alerts;
Insurance matters;
Claims;
Customer support;
Platform changes; and
Other service related matters.
These communications may be necessary to provide BeachCar™ services and may not always be subject to marketing preferences.
BeachCar™ may also send promotional or marketing communications where permitted by law.
Users may unsubscribe from marketing emails using the unsubscribe mechanism included in those communications.
Opting out of marketing communications does not prevent BeachCar™ from sending operational or legally required messages.
8. DATA RETENTION
BeachCar™ retains personal information only for as long as reasonably necessary for the purposes for which it was collected and for legitimate business, legal, accounting, tax, fraud prevention, insurance, dispute resolution, and security purposes.
Retention periods may vary depending upon the category of information.
BeachCar™ considers factors including:
The duration of the account relationship;
The duration of a rental or Host relationship;
Applicable statutes of limitation;
Tax and accounting obligations;
Insurance requirements;
Claims or litigation;
Regulatory obligations;
Fraud prevention requirements;
Security requirements; and
The sensitivity of the information.
BeachCar™ may retain information for a longer period where required by law, necessary for pending litigation or claims, or reasonably necessary to protect the Platform and its users.
Information that has been aggregated or deidentified so that it cannot reasonably be associated with an identifiable individual may be retained for a longer period where permitted by law.
9. DATA SECURITY
BeachCar™ uses administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, disclosure, alteration, destruction, misuse, or loss.
Security measures may include access controls, authentication systems, encryption, logging, network security, vendor controls, employee access limitations, and other safeguards appropriate to the nature and sensitivity of the information processed.
No internet service, computer system, mobile application, database, or electronic storage system can be guaranteed to be completely secure.
Users are responsible for maintaining the confidentiality of their BeachCar™ credentials and should immediately notify BeachCar™ if they believe an account has been compromised.
10. DRIVER AND HOST RESPONSIBILITIES
Drivers and Hosts may receive personal information about one another solely because of a BeachCar™ transaction.
Drivers and Hosts may use such information only for legitimate purposes associated with the applicable reservation, transaction, safety matter, claim, dispute, or legal obligation.
Users may not collect, retain, disclose, sell, publish, or otherwise use another BeachCar™ user’s personal information for unauthorized marketing, harassment, discrimination, surveillance, identity theft, fraud, or other unlawful purposes.
Hosts must comply with applicable privacy, recording, surveillance, telematics, and consent laws governing technology installed in or associated with their vehicles.
11. PRIVACY RIGHTS
Depending upon where you reside and applicable law, you may have the right to request that BeachCar™:
Confirm whether we process your personal information;
Provide access to personal information maintained about you;
Provide information concerning categories of information collected;
Correct inaccurate personal information;
Delete certain personal information;
Provide a portable copy of certain information;
Restrict or limit certain processing of sensitive information;
Opt you out of certain sales or sharing of personal information;
Opt you out of targeted advertising;
Opt you out of certain qualifying profiling activities;
Withdraw consent where processing is based upon consent; or
Provide additional information concerning our data practices.
These rights are subject to exceptions and limitations under applicable law.
BeachCar™ may need to verify your identity before completing a privacy request.
BeachCar™ will use information submitted in connection with a privacy request for purposes of authenticating and responding to the request.
Where permitted by law, an authorized agent may submit a request on your behalf. BeachCar™ may require evidence demonstrating the agent’s authority and may separately verify the request with you.
BeachCar™ will not unlawfully discriminate against an individual for exercising an applicable privacy right.
12. APPEALS
Residents of jurisdictions providing a legal right to appeal a decision concerning a privacy request may submit an appeal by contacting BeachCar™ through the privacy contact information below and stating that the request is a “Privacy Appeal.”
BeachCar™ will process qualifying appeals in accordance with applicable law.
13. CALIFORNIA PRIVACY RIGHTS
California residents may have additional rights under the California Consumer Privacy Act, as amended.
Depending upon the applicability of California law, these rights may include the right to know or access certain personal information, request correction, request deletion, opt out of the sale or sharing of personal information, and limit certain uses and disclosures of sensitive personal information.
BeachCar™ does not discriminate against consumers for exercising applicable California privacy rights.
Where BeachCar™ is legally required to process an opt out preference signal, including a qualifying Global Privacy Control signal, BeachCar™ will process the signal in accordance with applicable law.
Requests may be submitted using the BeachCar™ privacy request process described below.
14. OTHER UNITED STATES STATE PRIVACY RIGHTS
Residents of Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia, and other jurisdictions with applicable comprehensive privacy legislation may have additional rights regarding personal information.
The availability and scope of these rights depend upon the jurisdiction, the applicability of the particular law to BeachCar™, the type of information involved, and applicable statutory exceptions.
BeachCar™ will process qualifying privacy requests in accordance with applicable law.
15. PRECISE GEOLOCATION
Because BeachCar™ facilitates vehicle access and rental transactions, certain features may require vehicle location information.
BeachCar™ recognizes that precise location information is sensitive.
BeachCar™ may process precise location information where reasonably necessary for:
Vehicle access;
Rental administration;
Pickup and return;
Roadside assistance;
Vehicle security;
Theft prevention;
Vehicle recovery;
Fraud prevention;
Accident investigation;
Claims administration;
Safety;
Compliance with rental agreements; and
Other legitimate Platform functions.
BeachCar™ does not sell Driver trip location histories.
BeachCar™ does not use Driver trip histories to create advertising profiles concerning visits to sensitive locations.
Where consent is required before processing precise geolocation information, BeachCar™ will request the required consent.
16. BIOMETRIC AND IDENTITY VERIFICATION TECHNOLOGIES
BeachCar™ or an authorized identity verification provider may offer identity verification features that use photographs, selfies, identity documents, facial comparison technology, or similar methods.
Use of identity verification technology does not necessarily mean BeachCar™ itself receives or retains biometric identifiers.
Where BeachCar™ or a service provider collects or processes information legally classified as biometric information, BeachCar™ will provide any separate notice, consent, retention disclosure, or other procedure required by applicable law.
BeachCar™ will not sell biometric identifiers.
17. AUTOMATED FRAUD, SAFETY, AND ELIGIBILITY SYSTEMS
BeachCar™ may use automated rules, risk models, fraud detection systems, or similar technologies to assist with account security, fraud detection, vehicle protection, transaction review, or eligibility decisions.
These systems may evaluate information such as transaction activity, account history, device information, identity verification results, payment risk indicators, or rental activity.
Where applicable law provides a right regarding automated decision making or qualifying profiling, BeachCar™ will provide the applicable notice or mechanism required by law.
18. DEIDENTIFIED AND AGGREGATED INFORMATION
BeachCar™ may create aggregated or deidentified information that cannot reasonably be linked to an identifiable individual.
BeachCar™ may use such information for analytics, product development, operational planning, security analysis, financial analysis, vehicle utilization analysis, service improvement, research, or other lawful business purposes.
BeachCar™ will not attempt to reidentify information treated as deidentified except as permitted by applicable law, including where necessary to evaluate whether deidentification processes are effective.
19. CHILDREN
BeachCar™ services are not directed toward children under 18 years of age.
BeachCar™ does not knowingly permit children under 18 to create BeachCar™ rental or Host accounts.
Individuals must satisfy the age, licensing, and other eligibility requirements contained in BeachCar™’s Terms of Service, Rental Agreement, Host Agreement, or other applicable policies before renting or operating a vehicle.
If BeachCar™ learns that it has collected personal information directly from a child in violation of applicable law, BeachCar™ will take reasonable steps to delete or otherwise appropriately process that information.
20. INTERNATIONAL USERS
BeachCar™ is principally designed to provide vehicle rental and vehicle sharing services within the United States unless BeachCar™ expressly announces availability in another jurisdiction.
Information collected through BeachCar™ may be stored or processed in the United States or another country in which BeachCar™ or its service providers maintain operations.
Users accessing BeachCar™ from outside the United States should understand that privacy and data protection laws in the United States may differ from the laws of their jurisdiction.
If BeachCar™ intentionally expands its services into a jurisdiction requiring additional privacy disclosures, lawful processing grounds, international transfer mechanisms, representatives, or other protections, BeachCar™ may provide a jurisdiction specific privacy notice.
21. THIRD PARTY SERVICES AND LINKS
The Platform may contain links to websites, applications, payment services, mapping services, insurance services, or other services operated by third parties.
This Privacy Policy does not govern the independent privacy practices of third parties when those organizations process information for their own purposes.
Users should review the privacy policies of third party services they choose to use.
22. BUSINESS TRANSFERS
If BeachCar™ is involved in a merger, acquisition, financing transaction, asset sale, restructuring, bankruptcy, insolvency, or similar corporate event, personal information may be transferred as part of the transaction where permitted by law.
BeachCar™ will take reasonable measures to require the recipient to process personal information in accordance with applicable legal requirements.
23. CHANGES TO THIS PRIVACY POLICY
BeachCar™ may update this Privacy Policy periodically to reflect changes to our services, technologies, business practices, legal obligations, or privacy practices.
When the Privacy Policy is updated, BeachCar™ will revise the “Last Updated” date.
Where required by law, BeachCar™ will provide additional notice before a material change becomes effective.
Continued use of the Platform after an updated Privacy Policy becomes effective constitutes acknowledgment of the updated notice to the extent permitted by applicable law.
